Terms & Conditions
Excursion Purchase:
1.1. All purchases of an Excursion must be made over the phone.
1.2. The payment may be by credit or debit card. We may make a small charge for the use of some cards. You may also pay by cheque, but booking is not confirmed until the funds clear.
1.3. This contract is made with you, but you can give an excursion (on the terms of this contract) to someone else provided you tell us in writing. These Terms and Conditions will still apply and “you” in the rest of these Terms and Conditions will refer to that person.
1.4. It is our intention that all the terms of the contract between us are contained in these terms and conditions and associated documents (if any) issued by us. If you wish to rely upon any variation in these terms you should ensure that the variations are agreed in writing by us when you return your booking form.
1.5. You can claim a refund for your voucher within 7 working days commencing on the working day after you receive the booking confirmation from us. Thereafter all payments are non-refundable except as specified in clause 2.6 below. Refunds will always be made to the person who paid for the voucher, and if originally purchased by a credit/debit card, the refund will be credited to the same credit/debit card. Excursions are a personalised item and you will incur a £25.00 refund administration charge per person. The purchaser or the person(s) for whom the excursion is intended need to be aware that the provision of the service is both seasonal and entirely weather dependent and may occur more than 30 days after the transaction.
Our obligations to you:
2.1. Your booking will entitle you to participate in a Wessex Wildlife Photography excursion on the date decided between you and us. We may decide to rearrange the date of the excursion to avoid inclement weather or other unforeseen circumstances. You payment includes the refreshments and meals as stated in the Excursion description.
2.2. The booking form is not redeemable for cash.
2.3. The success of our Excursions are largely determined by the weather and the unpredictable behavious of wild animals and plants. It may be necessary to postpone an Excursion at any time if in our judgment the conditions are not safe or the Excursion would not be successful. We will give you as much warning as we can of any postponement, but in order to ensure your safety we reserve the right to postpone an Excursion at any time up to the start of the Excursion. If your excursion is are suspended for some reason, beyond the company’s control, then we will provide you with an alternative date.
2.4. It is intended that the excursion will last for the time stated in the description. However, David may judge that the Excursion has to end early if conditions such as weather or other things pertaining to safety and comfort change. We cannot guarantee that an excursion will follow any predictable sequence of events.
2.5. If we have to postpone your Excursion on five or more occasions you will be eligible for a free extension of your booking.
2.6. We will make you a refund less our reasonable marketing and administration costs (see Clause 2.9.) in the following circumstances:
i. If you die or it is certified by a doctor that there is no possibility that you will be or were medically fit to attend (other than by reason of pregnancy).
ii. If we have agreed in writing at the time of the booking that the Excursion must be taken on a specified date or within a specified period of time of not more than one month and we are unable to accommodate you.
2.7. If you are unable to attend the Excursion because you are pregnant we will provide you with an alternative date.
2.8. Refunds in any other circumstances are at our discretion and any request for a refund must be made in writing.
2.9. Our marketing and administration costs are £25 per person.
2.10. We carry limited insurance cover against the risk of any injury or damage to our clients during the Excursion. If you do not consider that the amount of insurance cover would be adequate to compensate you for any loss whether for death or personal injury or damage to your belongings you should take out your own additional cover. We will not be liable for any loss or damage to equipment and effects brought with you on the Excursion nor for death or personal injury above the level of our insurance cover unless it has been caused by our recklessness.
2.11. We do not accept liability for any costs or expenses you incur if we have to postpone the Excursion, where the reason for the postponement is beyond our control.
2.12. We cannot supervise vehicles parked at any meeting point for an Excursion and vehicles and their contents are left at your risk and no liability is accepted for any loss or damage to your vehicle or contents unless it is due to our negligence.
2.13. If an Excursion is postponed by circumstances beyond the control of Wessex Wildlife Photography, then we will offer you an alternative date. We cannot be held liable for any of the client’s losses or cost of whatever nature that result from the suspension of Excursions in accordance with this clause.
Your obligations:
3.1. Your booking is valid for a period of 12 months from the date upon which it was bought, unless stated otherwise. If your Excursion is not taken within that time you will lose the right to participate in an Excursion unless you have booked excursions on five occasions which have had to be postponed, or the validity period of the booking has been extended for some other reason under these terms and conditions.
3.2. You must contact us a minimum of two months prior to the expiry date shown on the booking form, quoting the booking number on the form, if you wish to extend the period of validity. If you do not do so and do not attend your Excursion within the validity period the booking will expire at the end of its validity period and you will lose the right to attend. We will not make any refund in these circumstances.
3.3. If payment was not made in full when the Excursion was purchased the balance must be paid thirty days before the first date for which you book your flight.
3.4. You must telephone to check that the Excursion has not been affected by adverse weather conditions in accordance with our instructions.
3.5. You may postpone your Excursion by speaking to us direct by phone or email (office hours are 08.30am – 5:30pm) a week (7 days) before the first day of the Excursion. An answering machine message is not acceptable as a method of postponement.
3.6. If you do not give notice of postponement in accordance with Clause 3.5. or do not attend in time to attend your Excursion as arranged, you will not be entitled to a re-scheduled Excursion nor to any refund.
3.7. We are not qualified to express an opinion confirming that you are fit to attend and take part in one of our Excursions. You must ensure that you are fit to attend. You must not attend if you are suffering from any serious medical condition, or have recently undergone surgery, unless you have a certificate of your fitness to do so from your doctor. You may not attend if you are under the influence of alcohol or drugs, or if we have good reason to suspect that you are in such a condition.
3.8. Our paramount consideration is your safety and the safety of others participating in the Excursion and you must obey all requests and instructions issued by David or any of our representatives and take particular care to abide by any safety instructions given.
3.9. We will accept bookings for children under the age of 14 years. A child under the age of 16 years will only be accepted if accompanied by a responsible adult for whom a full charge will also be made.
3.10. You should wear appropriate clothing as is advised to you. We will assume that you have followed instructions to observe weather forecasts and plan your own clothing needs accordingly.
3.11. Outdoor activities intrinsically involve the possibility of physical risks greater than those encountered in daily life even though they are conducted under the supervision of an experienced guide. By taking part in such activities, clients are understood to be fully aware of these risks.
Discounts and Offers
4.1. Wessex Wildlife Photography will offer discounts and offers as and when appropriate, entirely at our own discretion.
